Martus Privacy Notice

Please read this privacy notice (“Privacy Notice”) carefully as it describes our collection, use,  disclosure, retention and protection of your personal information. This Privacy Notice applies to any website, application or service which references this Privacy Notice. When you provide us with your personal information or when we collect it in any of the ways described below, you agree that we may collect, store and use it: (a) in order to perform our contractual obligations to you; (b) based on our legitimate interests for processing, i.e. for internal administrative purposes, data analytics and benchmarking, direct marketing, maintaining automated back-up systems or for the detection or prevention of crime); or (c) based on your consent, which you may withdraw at any time, as described in this Privacy Notice.

Martus Solutions, LLC, (“Martus”)  a limited liability company organized under the laws of  South Carolina, has created this Privacy Notice to describe how we collect, use and disclose the information that we obtain from our users through the Martus website(s) (the “Site”), including www.martussolutions.com, and the data we collect through the services we provide in the Martus application (“Services”) to our customers (“Customers”) and to individual end-users “End Users” who are provided with access to the Services by Martus’ Customers. This Privacy Notice also describes the choices available to you regarding our use of your personal information and how you can access and update this information. By visiting the Site and using any Martus Services, you signify your explicit consent to the terms and conditions of this Privacy Notice. This Privacy Notice may be relevant to you even if you are not a customer or direct contact of  ours - even if you have never used a website, application or service of ours. We may have your personal information because we have received it from a user of a website, application or service of ours.

Information Collection and Use on the Site

To the extent permissible under applicable law, we collect information about you and any other party whose details you provide to us when you:

  • Register to use our websites, applications or services (including free trials); this may include your name (including business name), address, email address and telephone number. We may also ask you to provide additional information about your business and your preferences.
  • Place an order using our websites, applications or services; this may include your name (including business name), address, and contact info (including telephone number and email address).
  • Use our Services, which may include the collection of metadata.
  • Complete online forms (including call back requests), take part in surveys, post on our message boards, post any blogs, enter any competitions or prize draws, download information such as white papers or other publications or participate in any other interactive areas that appear on our website or within our application or service.
  • Interact with us using social media.
  • Interact with us through our chatbots.
  • Provide your contact details to us when registering to use or accessing any websites, applications or services we make available or when you update those details, and
  • Contact us offline, for example by telephone, fax, SMS, text message, email or mail.

We will also collect your information where you only partially complete and/or abandon any information inputted into our website and/or other online forms and may use this information to contact you to remind you to complete any outstanding information and/or for marketing purposes.

We also collect information from your devices (including mobile devices) and applications you or your users use to access and use any of our websites, applications or services. For example, we may collect the device identification number and type, location information and connection information such as statistics on your page views, traffic to and from the sites, referral URL, ad data, your IP address, your browsing history and your web log information. We may do this using cookies or similar technologies (as described below).

We use this information to provide you with information about the products and services that we provide and to send information regarding Martus, its products, and/or its partners, such as newsletters, promotions, and events.

End User Information Collection and Use through the Services

Martus Customers contract with Martus to make the Services available to End Users. When you use the Martus Services provided by your organization, Martus’ processing of your personal data in connection with the Services is governed by a contract between Martus and its Customer. Martus processes your personal data to provide the Services to your organization and you, and in some cases for Martus’ business operations related to providing the Services as described below.

Martus requires End Users who register to use the Services to provide their email address and name. The email address is used for user identification and authorization within the Services. If an individual refuses to provide an email address and name, they cannot become a registered End User of Martus’ Services.

It is Martus’ obligation, as the data controller, to inform its Customers and registered users about the purposes for which information about them is collected and may be used on the Services, to obtain End User consent, and to maintain a record of the End User’s consent. Registered users can update their account information at any time by logging into the Site and editing their account information. Registered users cannot remove their data, since the information collected about registered users is key to user identity within the Service and historical tracking of data updates they have made on behalf of their organization. Requests to remove user data will be denied. However, after a Customer’s subscription is terminated, user information for the end-users associated with that customer will be deleted in accordance with Martus’ data retention policy.

Martus uses the personal information that we collect to make the Services available to registered users and to send administrative and transactional emails related to and generated by the Services. Martus may use the account information to contact registered users to further discuss customer interest in Martus and its products and services and the Services that we provide. Martus may email information regarding updates to the functionality and behavior of the Services, Service status updates, notices about available training and webinars, and other communications about the Services. Except as we explicitly state at the time we request information, we do not disclose to third parties the information provided.

Registered users of the Services employ the Service to host data and information ("Data"). Martus will not review, share, distribute, print, or reference any such Data except as provided in your Subscription Agreement, or as may be required by law. Individual records may at times be viewed or accessed for the purpose of resolving a problem, support issue, improving system performance, or suspected violation of your Subscription Agreement, or as may be required by law. Users are responsible for maintaining the confidentiality and security of their user registration and password.

Upon request Martus will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. To request this information please contact us at privacy@martussolutions.com.

Martus will retain personal information we process on behalf of our Customers for as long as needed to provide services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We take the integrity of our Customers’ information very seriously and at no point is any private financial information collected, analyzed, or disseminated. We may from time-to-time monitor when a Customer uses the Martus Service, and the frequency with which certain functions are used. This information will be used solely for internal analyses to help us to improve the functionality of the Martus Services.

Testimonials

We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at privacy@martussolutions.com.

Passive Collection

We gather certain information automatically. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or click data to analyze trends in the aggregate and administer the site.

Cookies and Other Technologies

Technologies such as cookies, beacons, tags, and scripts are used by Martus and our marketing partners, affiliates, or analytics service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our aggregate user base. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We use cookies to recognize your browser when you visit and to tell us whether customers and visitors have visited the Site previously, and to make it easier for you to navigate our site. Visitors to our Site can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

Information Sharing and Disclosure

Martus will not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide the Services that you have requested, when we otherwise have your permission, or under the following circumstances:

  • To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Martus’s Terms of Use, or as otherwise required by law.
  • When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • In connection with a merger, acquisition, sale of assets of Martus or in the event of bankruptcy. If Martus or our assets are acquired by another company, that company will assume the rights and obligations as described in this Privacy Notice.

Access to Your Account Information and Updating Information

You have the right and ability to edit your account information, at any time. Registered users can update their account information at any time by logging into the Services and editing their account information, or by emailing us at privacy@martussolutions.com. We will respond to your request to access your account within 30 days.

You can also opt in or out of receiving future communications of special offers and new product information by sending us an email at privacy@martussolutions.com, or you can unsubscribe by following instructions contained in the messages you receive. We do reserve the right to send you certain communications relating to the Service, such as service announcements and administrative messages, and we do not offer you the opportunity to opt out of receiving those messages.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you with services, contact us at privacy@martussolutions.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Security

The security of your personal information is important to us. When you enter sensitive information (such as login credentials), we encrypt the transmission of that information using secure socket layer technology (SSL).

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. The Site may contain links to other websites. This Privacy Notice only applies to the Martus Site and Services, and we are not responsible for the privacy practices or content of other websites. We may update this Privacy Notice to reflect changes to our information practices. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our Site prior to the change becoming effective.
